This is an excerpt from our 'Conditional Sales Agreement', you can download the entire document HERE 1) The Seller warrants that the Goods will be fit for the purpose for which such goods are ordinarily intended. 2) The Seller warrants that all in-wall wiring is guaranteed to be 100% free from defects in material and workmanship. The warranty period will be for as long as the original Purchaser remains the owner of the property where services were rendered or 10 years, whichever is less, unless; a) the dwelling at any time has been, will be, or is intended to be subject to tenancy; in this case the warranty will be for 1 year after 100% job completion as per Paragraph 5 of this Agreement, or; b) at the Purchaser’s express request, lines are left exposed in any living space and are not terminated inside the wall cavity and covered by an appropriate wall mounted trim plate; in this case, proper functionality of the line will be demonstrated to the Purchaser upon possession, however the line in question will not be covered by any warranty express or implied.. 3) Unless excluded by paragraphs 2a or 2b, lines left exposed in a mechanical space or room will be guaranteed as per Paragraph 16. 4) The full manufacturer’s warranty will apply to any and all defective equipment, warranty claims will proceed as follows: a) The Purchaser must contact and inform the Seller of any problems, a Service Technician will then visit the residence at some time convenient to both parties to determine whether or not there is a defect that is covered by any applicable warranty; b) If the Service Technician determines that the defect in question is equipment related and may be covered by the manufacturer’s warranty, the equipment will be removed from the residence and returned to the Seller’s place of business in order to process the claim; c) If the equipment must be returned to the manufacturer’s facility or some other location for service or repair, the Purchaser may be required to pay forward shipping charges. d) In any case where equipment is covered by an applicable warranty, return of the repaired or replacement equipment will be scheduled as soon as said equipment becomes available to the Seller, local delivery and re-installation will be free of charge. e) The Seller will make every effort to ensure the speedy processing of all warranty claims, however the Seller will not be held responsible for any delays that are beyond the Seller’s control such as but not limited to repair time, back order or transportation delays. 5) Wiring defects will be repaired free of charge, as will any cosmetic damages to the building that may result from said repairs, however, the warranty will be limited to the repair or replacement of the defective line(s) and the possible resulting cosmetic damages but does not include; a) any repairs required due to Act of God, vandalism, mishap, accident, misuse, tampering or service performed by someone other than the Seller, and; b)
any and all losses or damages that may have been incurred as a
result of any defect. 6)
Any Repair Services provided that are not specifically covered by
an applicable warranty will be billable at Standard Service Rates and payment
will be due upon completion of said Repairs. 7)
EXCEPT FOR THE ABOVE WARRANTIES, NO OTHER WARRANTY (WHETHER
EXPRESS, IMPLIED OR STATUTORY) IS MADE BY THE SELLER REGARDING THE GOODS.
